Part 1 – Ticket Terms and Conditions

  1. INTRODUCTION
    1. Please read these Terms and Conditions carefully as they affect your (“you”, the “participant”) rights and liabilities under the law and set out the terms under which Croydon Limited Partnership (the “Centre Owner”) and Jones Lang Lasalle (JLL) (together, the “Event Organisers“) make Costa del Croydon (the “Event”) and the sessions at the Event (the “Sessions“) as is described in more detail at clause 8 below available for use.
    1. By booking or being issued tickets for the Event (the “Ticket(s)”) or by participating in the Sessions you are deemed to have accepted and agree to adhere to these terms and conditions in Part 1 and the Conditions of Entry specified in Part 2 (the “Terms”). The Centre Owner reserves the right to amend these Terms from time to time.
    1. Subject to these Terms, participation in the Sessions is entirely at the participant’s own risk.
  1. These Terms are additional to and not a substitute for the general terms and conditions of use of our website, which can be found at https://www.centraleandwhitgift.co.uk/terms-conditions.
  • ADMISSION

Tickets, Walk-ins and Age Restrictions

  • All Tickets are available to book via Eventbrite website and are subject to Eventbrite terms of service . By booking or being issued the Tickets you are deemed to have accepted and agree to adhere to such terms of service, in addition to these Terms.
  • Walk-ins are accepted but are strictly subject to availability and on a first come first served basis.
  • Please ensure you arrive with plenty of time for your Session, admittance in the last 30 minutes may not be permitted due to capacity restrictions at the Event.
  • A parent or guardian remains fully responsible for the health and safety of their children under the age of 16 at the Sessions at all times.
  • Tickets are only valid for the time and date for which they were ordered. We reserve the right to refuse entry should a ticket be used outside its valid time and date.
  • Only persons with a valid Ticket will be permitted entry to the Event.

Ticket Conditions

  • You must not auction, donate, offer for sale, loan or advertise your Tickets for sale via the internet or elsewhere. You must not use Ticket(s) as prizes in promotions, sweepstakes, hospitality packages, auctions, lotteries or competitions (including those used for charity) without our prior written consent.
  • A Ticket(s) obtained in breach of the Terms, or which in our reasonable opinion is being used or is intended to be used in breach of the Terms, shall be void. This may include you being refused entry to the Sessions or your Ticket(s) being cancelled without notification.

Session Rules

  • All participants must adhere to the Terms and Conditions of Entry and any specific rules of any event activities you participate in.
  • All participants are responsible for their wellbeing whilst  at the Event and must bring any medication they require, including but not limited to asthma pumps.
  • Once the Session you have participated in finishes, you must leave that Session to allow others with a later booking time to enter.
  • The Event Organisers reserve the right to refuse admission to the Event and/or any Session at their sole discretion including, for example, for health and safety, licensing reasons or where a Ticket is invalid for any reason.
  • The Event Organisers reserve the right to request participants to leave the Event or Centrale Shopping Centre (the “Centre“) at any time and may take appropriate action to enforce this right.
    • The Event Organisers may refuse access to or may remove a participant from the Event or the Centre who:
  • Has not adhered with the Terms and Conditions of Entry for the Event;
  • has been convicted of a criminal offence which, in the opinion of the Event Organisers, is likely to affect the safety or enjoyment of other visitors;
  • has behaved in a manner which is likely to affect the safety or enjoyment of other visitors;
  • has used threatening, abusive or insulting words or behavior or behaves in a manner which may provoke a breach of the peace, or deliberately damages the Event or any part of or property at the Centre; or
  • in the reasonable opinion of the Event Organisers is acting under the influence of alcohol or drugs.
  • HEALTH AND SAFETY
  • The Event Organisers may carry out security searches from time to time to ensure the safety of all visitors and you agree to allow yourself and/or your belongings to be searched prior to admittance to the Event in order to prevent offensive or dangerous weapons from being taken into the Event or the Centre.
  • You will not take any weapons, glass bottles, flammable liquids or any other item that the Event Organisers may consider is dangerous into the Event.
  • Smoking (including the use of e-cigarettes), and the use of commercial photographic and recording equipment are strictly prohibited at the Event.
  • You will comply with all relevant safety announcements and instructions whilst at the Event.
  • LIMITATION OF LIABILITY
  • Whilst the Centre Owner makes every effort to monitor those aspects of the Event which are fulfilled by third party suppliers of the Event (“Event Suppliers”), any liability incurred by you which is caused by the acts or omissions of the Event Supplier(s) is the responsibility of the Event Supplier(s) and not the responsibility of the Event Organisers. The Event Organisers shall not be liable for the death of or personal injury to any Event attendees which arises from or is caused by events outside of the Event Organiser’s reasonable control including the acts or omissions of the Event Suppliers.  The Event Organisers shall have no liability for damage to property, consequential loss or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses, resulting in third party claims. You waive all rights of whatsoever nature against the Centre Owner, Jones Lang Lasalle Limited (“JLL“) and Westfield Europe Limited (“Westfield“) and each of their employees, servants, agents, independent contractors or representatives in respect of injury, death, loss or damage arising from your participation in the Sessions or attendance at the Event.
  • Nothing in these terms and conditions affects your statutory rights. These Terms are subject to the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the English courts.
  • The Centre Owner shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to delivery charges, custom or duty tax, travel expenses and car parking fees and/or any other out of pocket expenses.
  • The Centre Owner does not accept responsibility for (i) network, computer, hardware or software failures of any kind which may restrict or delay the purchase or delivery of items, or (ii) any act or default of any third party supplier which is outside of the Centre Owner’s reasonable control.
  • Except as set out in paragraph 4.1 above, nothing in the Terms shall exclude or restrict the Centre Owner’s, JLL’s or Westfield’s liability for death or personal injury caused by its negligence or the negligence of its officers or employees or for any fraudulent misrepresentation.
  • OPENING HOURS AND AVAILABILITY
  • The Event Organisers reserve the right to:
  1. change the advertised dates, opening hours and schedule of the Event or any of the Sessions; and/or
  2. close or cancel Sessions or the Event itself,

without notice or liability, where we deem it reasonable to do so.

  • The Event Organisers will, where possible, give prior notice of any action under clause 5.1 above.
  • GENERAL
  • Attendance at the Event does not confer any rights (by implication or otherwise) on you to use, alter, copy or otherwise deal with any of the trade marks, logos and/or intellectual property appearing on the Event website.
  • Save that any company in the Centre Owner’s or Westfield’s group of companies, as well as the Centre Owner and JLL, may benefit from these Terms, no person who is not a party to these Terms shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.
  • Nothing in these Terms affects any of your statutory rights which may not be legally excluded.
  • Enforcement of these Terms is solely at our discretion, and just because we may not enforce them in some circumstances does not mean that we have lost the right to enforce in future.
  • HOW WE USE YOUR PERSONAL DATA

If the Centre Owner receives personal information from you, it will use this personal data in accordance with data protection laws and its privacy notice (https://www.centraleandwhitgift.co.uk/privacy-policy). This notice explains how the Centre Owner processes your personal data, your rights, and how you can contact it. The Centre Owner’s data protection team can be contacted at DPO@urw.com.

  • Event
  • Subject to clause 5.1 above, the Event will take place at the Centrale Car Park on the dates and times advertised.

Part 2

Conditions of Entry

1. Terms and Conditions of Entry – Costa del Croydon, Centrale Car Park

  • All visitors must have a valid ticket to obtain admittance to the Event. By entering this Event, the visitor accepts to adhere to the Terms and Conditions.
  • Only small handbags or rucksacks will be permitted into the Event. We ask all visitors to be vigilant and not to leave bags or belonging unattended at any time. We cannot accept liability for loss or theft of any personal items.
  • No animals are permitted at the Event, except guide dogs. 
  • Tops and footwear must be worn at all times at the Event.
  • Balls must not be brought into the Event. Ball games is strictly prohibited at the Event.
  • For your safety and the safety of others, please do not climb, stand or sit on balustrades, barriers, fencing or railing in and around the Event and associated areas.
  • Visitors must comply with any and all instruction by Event staff at the Event.
  • Bikes, roller blades, micro-scooters, skateboards, Heelys (or similar) and other leisure transportation are not permitted to be taken into the Event.
  • Commercial photography, videography, or the use of drones is not permitted at the Event, except with prior permission from Event organisers.
  • Visitors may bring own food and drink into the Event. No alcohol is permitted to be taken into or taken from the Event. Alcoholic beverages must be purchased at the Event and consumed within licensed leisure and food establishments; we encourage visitors to drink responsibly.
  • Barbeques, fires or burning of any materials is not permitted anywhere at the Event.
  • We and our suppliers operate a strict Challenge 21 policy; valid ID is required to consume and purchase alcoholic beverages.
    • The following forms of ID shall be accepted: valid photo driving licence, valid provisional photo driving licence, valid passport, valid PASS card from the National Proof of Age Standards Scheme.
    • ID must be original, no copies or photos will be accepted.
    • We reserve the right to refuse service, if in our opinion (including that of any third parties instructed by us) there is any doubt that the ticket holder is under the age requirement.
    • Any person under the age of 18 drinking or in the possession of alcohol will have the alcohol confiscated and may be ejected from the Event.
    • Any person attempting to, or purchasing to supply persons under the age of 18 with alcohol will have the alcohol confiscated and may be ejected from the Event.
  • Smoking including the use of e-cigarettes is strictly prohibited at the Event.
  • The use of any illegal substances is strictly prohibited at the Event.
  • The possession of knives, offensive weapons, potential weapons, sharp articles, fireworks or any object or item considered to be potentially dangerous or harmful to public safety being a single item or potential component part for another object, laser devices, illegal drugs at the Event is strictly prohibited.
  • Any person in possession of any items listed above, prohibited items as notified in these terms or any item which at the discretion of the security considers to be unsafe or potentially posing a risk to public safety or security will be refused entry to the Event, removed from the Event, and/or will have such items confiscated and destroyed. Any article that might be used as a weapon, be deemed to be offensive or abusive, or compromise public safety, will be confiscated, and may be reported to the police. Confiscated items will not be returned.
  • All children or persons in your care at the Event must be appropriately supervised at all times by a responsible adult.
  • We do not allow intimidating, aggressive, or derogatory behaviour of any kind towards other visitors, staff or retailers.
  • We reserve the right to refuse admission or eject visitors from the Event if, in the opinion of security, the visitor has not complied with these terms and conditions of entry,  and/or is demonstrating anti-social behaviour, and/or carrying out illegal activity or in possession of illegal items, and/or is a risk to the safety of themselves or of any visitor and/or may affect the enjoyment of other visitors and/or the running of the Event or may cause damage, nuisance or injury.
  • We reserve the right to amend these terms and conditions of entry or impose additional conditions to ensure the safe management of the Event.
  • While every effort has been made to ensure a safe and enjoyable environment for our visitors, the Event Organisers are not liable for any injury, loss, damage (including damage to property or personal belongings) directly or indirectly arising out of or in connection with any third party at the Event.
